Treasury officials have confirmed during Senate Estimates that $2.3 billion in Energy Bill Relief payments were unlawful because of an administrative error involving the delegation used to authorise the payments. Damian White, Deputy Secretary of the Fiscal Group, explained that the policy itself and payment amounts were correct, but the delegation instrument authorised the wrong level of officer to approve the payments, creating a breach of Section 83 of the Australian Constitution. Treasury identified the issue through its internal processes, later found a related error involving the programme’s name, and reported the breach to the Australian National Audit Office and the Treasurer.
